Abstract
İnsanlığın ve doğadaki diğer tüm canlıların sağlıklı bir çevrede hayatını sürdürebilmesi için çeşitli önlemlerin alınması, hukuki düzenlemelerin yapılması gerekmiştir. Bu düzenlemelere uyulmaması halinde insanlık doğal felaketlerle ve salgın hastalıklarla mücadele etmek zorunda kalmıştır. Bir İslam devleti olarak maddi ve manevi temizliği ve tüm canlılara saygıyı esas alan Osmanlı Devleti hem şer’i hukuk uygulamaları hem de örfi hukuk düzenlemeleriyle dönemin çevre sorunlarına cevap aramıştır. Çevre temizliği konusunda halkın kolektif katılımının arandığı Osmanlı uygulamasında, temiz su kaynaklarını halka ulaştırmak ve korumak ise devletin görevi olmuştur. Çalışmanın amacı Osmanlı Devleti’nde İstanbul ve çevresinde yaşanan çevre sorunlarının, bu sorunlara yönelik alınan önlemlerin ve hukuki düzenlemelerin araştırılmasıdır.

Abstract
In order for all living things in nature to survive in a healthy environment, the actions of people should be controlled and preventive legal arrangements should be made. In cases where these regulations are not followed, humanity has had to struggle with natural disasters and epidemics. The Ottoman Empire, as an Islamic state, was based on material and spiritual cleanliness and respect for all living things. As an Islamic state, the Ottoman Empire, which was based on material and spiritual cleanliness and respect for all living things, tried to find answers to the environmental problems of the period with both religious law practices and customary law regulations. In the study, the extent of the environmental problems in Istanbul and its surroundings in the Ottoman Empire, what kind of measures were sought for solutions, and the legal regulations and practices regarding these problems will be discussed.
