Abstract
Osmanlı Devleti’nde başta padişah olmak üzere, hanedan üyeleri, yüksek dereceli devlet memurları, toplumun seçkin kişileri ve hayırseverler toplum yararına çeşitli vakıflar kurmuşlardır. Devlet bu vakıfların idame etmesi, korunması ve işlevini yerine getirebilmesi için çeşitli önlemler almış, yapılan suiistimaller karşısında sessiz kalmamıştır. Üst makamlara yapılan şikâyetler üzerinde durulmuş ve vakıflarla ilgili davalar en üst merci olan Divan-ı Hümâyûn’da görüşülerek çeşitli hükümler çıkartılmıştır. Yapılan bu çalışmada vâkıf şartlarına aykırı olarak yapılan bazı suiistimaller ve bu suiistimallere karşı devletin Divan-ı Hümâyûn’da çıkarmış olduğu bazı hükümler üzerinde durulmuştur.

Abstract
The Ottoman Empire, especially the sultans, including members of the dynasty, high-ranking civil servants, distinguished people of society and philanthropists have established various waqfs. The state has taken measures to maintain, protect and function these waqfs and has not remained silent in the face of abuses. Complaints made to senior authorities were emphasized and various provisions about waqfs were issued by discussing the highest court case in the Divan-i Hümâyûn. In this study, some abuses against the condition of waqf founder and some of the provisions of the state against the abuses have been discussed.
