Abstract

Çalışmada öz itibariyle incelenen konu, vergi hukukundaki e-tebligat hususuna ilişkin düzenlemelerin bir kısmının soyut norm denetimiyle itiraz yolu kullanılarak, Anayasa Mahkemesi önüne getirilmesi sonucu yüksek mahkeme tarafından verilen ertelemeli iptal kararının erteleme sürecindeki derdest davalarda iptal edilen hükmün mü yoksa iptal hükmünün kullanılacağı hususunun araştırılmasıdır. Böyle bir araştırma yapılırken Anayasa Mahkemesinde norm denetimi yapılırken hangi yolların kullanılabileceği, bunların sonunda verilen iptal kararlarının ertelenip ertelenemeyeceği anayasal hükümler çerçevesinde değerlendirilmiştir. Yine vergi hukuku özelinde belgelendirme ve bilgilendirme vasfına sahip olan tebliğ ve bunun elektronik yollarla yapılması hususunda e-tebligat düzenlemesi gözden geçirilmiştir. Son olarak çalışmanın ana gayesi olan vergi hukukunda e-tebligat hususunda Anayasa Mahkemesi tarafından verilen ertelemeli iptal kararı ile erteleme sürecindeki derdest davalarda uyuşmazlıkların çözümünde iptal edilen hüküm mü yoksa iptal hükmünün uygulanacağı incelenmiştir. Konuyla ilgili olarak yapılan değerlendirme sonucunda gerek vergi yargılamasındaki yerleşik içtihatlar gerekse de Anayasa Mahkemesi tarafından verilen kararların kesinliği, anayasaya aykırılığı tespit edilen hükmün kullanımının uyuşmazlıkların çözümünde kullanılmasının uygun olmayacağı hasebiyle Anayasa Mahkemesince verilen iptal hükmünün erteleme süresindeki derdest davalarda uygulanması gerektiği kanaatine varılmıştır.

Abstract

Essentially, the study examines whether, in cases pending during the postponement period of the Constitutional Court's decision to annul certain regulations concerning e-notifications in tax law through abstract norm control and appeal, the annulled provision or the annulled provision itself should be applied. In conducting such research, the methods that can be used during norm control in the Constitutional Court, and whether the resulting annulment decisions can be postponed, have been evaluated within the framework of constitutional provisions. Furthermore, within the context of tax law, the regulation concerning notifications that serve a documentation and informational purpose, and the e-notification system for delivering these notifications electronically, has been reviewed. Finally, the main objective of this study, concerning e-notifications in tax law, was examined in relation to the Constitutional Court's postponed annulment decision, specifically whether the annulled provision or the annulment provision should be applied in resolving disputes in pending cases during the postponement period. As a result of the evaluation conducted on this matter, considering both the established precedents in tax litigation and the finality of the decisions rendered by the Constitutional Court, and given that the use of the provision found to be unconstitutional would not be appropriate in resolving disputes, it has been concluded that the annulment ruling issued by the Constitutional Court should be applied to pending cases during the postponement period.
