Abstract
Bu çalışmada, sivil itaatsizliğin nasıl bir hukuk düzeninde ortaya çıkabileceği ele alınmış, kavrama yönelik farklı tanımlar göz önüne alınarak sivil itaatsizliğin unsurları tartışılmıştır. Sivil itaatsizlik kavramının meşruluğu sorunu Rawls’un gerekçeleri bağlamında incelenmiştir. Sivil itaatsizlik, demokratik bir yönetim biçiminde ve hukuk düzeninin olduğu toplum için söz konusu edilebilir. Sivil itaatsiz hukuk düzeni içerisindeki tekil bir adaletsizliğe karşı çıkar, yasayı ihlal ederken şiddet kullanmaz. Sivil itaatsizlik eylemi hukuk düzenini kökten değiştirme amacında değildir. Tam aksine hukuk düzenindeki eksikliği ya da haksızlığı düzeltme amacındadır. Bir sivil itaatsizliğin meşru olabilmesi için şiddet içermemesi, tekil bir haksızlığa karşı olması, eylemin aleni ve açık olması, mevcut düzeni değil düzen içindeki tekil bir haksızlığı hedef alınması ve gerçekleşen eylemin sonucundaki cezaya katlanılması gerekmektedir.

Abstract
In this study, it is discussed how civil disobedience can occur in a legal order and the elements of civil disobedience are discussed by considering different definitions for understanding. The question of the legitimacy of the concept of civil disobedience was examined in the context of the justifications of Rawls. Civil disobedience can be considered in the form of a democratic administration and a society of law. He opposes a singular injustice within the civil disobedient legal order, does not use violence while violating the law. The act of civil disobedience is not intended to fundamentally change the legal order. On the contrary, it aims to correct the lack of law or injustice. For a civil disobedience to be legitimate, it should be free from violence, against a single injustice, a clear and open action, not a current order, but a single injustice in order, and a punishment as a result of the action taken.
